Fabricating and Concealing Data on Smart Phones

Please join the Indianapolis Chapter of Women in eDiscovery for our June Chapter meeting where Greg Kelley of Vestige Digitial Investigations will dive into the eDiscovery implications of applications used to fabricate and conceal mobile metadata. Indiana CLE is currently pending for this event.

Smart phones are quickly passing up computers as the primary source of Electronically Stored Data. Methods of production of data from smart phones are not as well defined as production of data from computers, emails and other sources. To further complicate matters, concerns over the privacy of personal data which is mixed with business data on smart phones leads to partial collection and partial production methods. The result leads to a production of data in legal matters ranging from screenshots to PDF to Excel and everything in between. The entire situation opens up multiple avenues for the obfuscation or hiding of potentially relevant data. This presentation will provide real world examples of altered data provided in discovery and what was, and could be, done to prevent it.
