Technology Assisted Review (“TAR”) is an efficient option for limiting the amount of document review in discovery. However, some parties are reluctant to use TAR, because negotiating TAR protocols with an opposing side can be challenging. As a producing party, what is the right balance between refusing to disclose your TAR process or letting the other side dictate your process? As a receiving party, what disclosures should you insist be made? This session will address these topics and provide coverage on the following issues as well:
