2021 eDiscovery Case Law Update

Join us as she looks back at the top ten eDiscovery cases of 2021 and discusses how courts approached proportionality under the 2015 Rules; how privilege logging is still not uncomplicated despite the Rule 502(d) protections; and the challenges conducting discovery associated with mobile devices, social media, and other forms of communication like Slack, Teams, etc. Monica will also discuss the blockbuster sanctions case from the Northern District of Illinois, DR Distributors v. 21 Century Smoking, Inc., a cautionary tale about counsel who failed to take seriously their duty of competence when it comes to conducting discovery under the FRCP.
