Since the Federal Rule amendments in 2015 re-emphasized proportionality as a principle in relation to discovery, organizations have struggled to manage the discovery process in a proportional yet defensible manner. In fact, proportionality disputes doubled from 2019 to 2020. The new “Discovery Proportionality Model: A New Framework” is a significant step toward curing this problem, but how can corporations and law firms best put this into practice? This panel will discuss use cases and provide practical recommendations for discovery scoping and proportionality analysis.
